It is published in full below (for the first time in Italian), The Apostolic Constitution emanated in the form of the Bull "When ex Apostolate officio" il 15 March 1559.

The translation of the Bull, due to the large extension of the periods in the original Latin language, it seemed like a difficult job, therefore certain translations published in other magazines appear incorrect. The cause of this infidelity is due not only to the tendentiousness of certain translators who distorted the original meaning in favor of opposing opinions, but to the difficulty of certain Latin periods, very long and with very complicated verb forms. The Latin text is taken from the “Bullarium Romanum” typical edition published in Turin in 1860.

So long as, because of the role of Apostolate entrusted to us by God, albeit with unbecoming merits, The duty of general care of the Lord's flock lies upon us. And since for this reason, we are required to assiduously watch over its faithful guardianship and its saving direction and diligently provide as a vigilant Shepherd, that those who are rejected from the fold of Christ, in our times, induced by their sins, leaning beyond what is permissible in one's prudence, they rise up against the discipline of true orthodoxy and pervert the way of understanding the Holy Scriptures, by means of fictitious inventions, they attempt to separate the unity of the Catholic Church and the useless tunic of the Lord, and so that those who have disdained being disciples of the truth cannot continue in the teaching of error.

1 – Purpose of the Constitution:

Keep the wolves away from Christ's flock.

 

We, we believe that such a matter is so serious and dangerous that the Roman Pontiff himself, who acts on earth as Vicar of God and of Our Lord Jesus Christ and has had full power over all peoples and kingdoms, and he judges everyone without anyone being able to judge him, if he is recognized as having deviated from the faith, he can be reprimanded (may deviate from the faith, to be returned), and that the greater the danger, the more diligently and comprehensively one must provide, with the aim of preventing false prophets or other people invested with secular jurisdiction from miserably ensnaring simple souls and dragging countless peoples with them to perdition and eternal death., entrusted to their care and government for spiritual or temporal needs; nor should it happen at any time to see in the holy place the abomination of desolation predicted by the Prophet Daniel, eager as we are, as much as we can with God's help and as our duty as Pastor requires us, to capture the foxes busy destroying the Lord's vineyard and to keep the wolves away from the sheepfolds, so as not to appear like dumb dogs who don't feel like barking, so as not to suffer the condemnation of bad farmers or be assimilated to the mercenary.

2-Approval and renewal of previous penalties against heretics

After thorough examination of this question with our venerable brothers the Cardinals of the Holy Roman Church, with their opinion and unanimous consent, We, with Apostolic authority, we approve and renew each and every one, the sentences, censures and penalties of excommunication, suspension, interdiction and deprivation, in any way uttered and promulgated against heretics and schismatics by any of the Roman Pontiffs, our predecessors or existing in their name, including their uncollected letters, or by the sacred councils received by the Church of God, or by the decrees of the Holy Fathers, or of the sacred canons, or from the Constitutions and Apostolic Ordinances, and we want and decree that they be perpetually observed and that their current observance be returned to if by chance it falls into disuse, but it had to be in force; furthermore that they incur the aforementioned sentences, censures and punishments for all those who have been, until now, caught in the fact or have confessed or have been convinced or have deviated from the faith, or of having fallen into some heresy, or incurred a schism, for having promoted or committed them, of any state (each state), degree, order, status and pre-eminence they enjoy, even if episcopal (also episcopal), archiepiscopal, primatial or other greater dignity (or others of greater ecclesiastical dignity) such as the honor of the cardinalate or the office (function) of the legation of the Apostolic See in any place, both perpetual and temporary; as much as it shines with worldly authority and excellence such as the comital, the baronial, the marquis, the ducal one, under the direction of an imperiale.

3 – On the penalties to be imposed on the hierarchy

Considering no less than, those who do not abstain from evil for the sake of virtue, deserve to be turned away for fear of punishment and that the bishops, archbishops, patriarchs, receive, cardinals, tied, conti, barons, marquises, dukes, kings and emperors, who must instruct others and give them a good example to keep them in the Catholic faith, by prevaricating they sin more gravely than others as they damn not only themselves, but they drag with them to perdition into the abyss of death other countless peoples entrusted to their care or government, or otherwise subjected to them; We, upon similar notice and consent (of the cardinals) with this Constitution of ours valid forever (will prevail forever), in hatred of such a serious crime, in relation to which no other can be more serious and pernicious in the Church of God, in the fullness of Apostolic power (of the fullness of the Apostolic power), we sanction, let's establish, we decree and define (and we define), that the aforementioned sentences remain in their force and effectiveness, censures and penalties and produce their effects, for each and every one (each and every one) of the bishops, archbishops, patriarchs, receive, cardinals, tied, conti, barons, marquises, dukes, kings and emperors who, as before has been established to this day, were caught in the act, or have confessed or been convinced of having deviated from the faith or have fallen into heresy or have incurred a schism for having promoted or committed it, or those in the future, are caught in the act for having deviated from the faith or for having fallen into heresy or incurred a schism, for having caused or committed it, they will confess it as much as if they were convinced of it, for such crimes make them more inexcusable than others, beyond the sentences, aforementioned censures and penalties, they are also (they are also), for the very fact (by himself) and without the need for any other legal or factual procedure, (without any service of law or fact) wholly and totally private in perpetuity (completely and permanently deprived of the whole) of their Orders, of their cathedral churches, even metropolitan ones, patriarchal and primatial, of their cardinal dignity and of every role of Legate, as well as every active and passive voice and every authority, as well as monasteries, ecclesiastical benefits and offices (and ecclesiastical offices) with or without care of souls, be they secular or regular of any order that they had obtained through any Apostolic concession or dispensation, or others as owners, to be recommended, administrators or in any other way and in which they benefited from some rights, although‚ they will be equally deprived of all fruits, annuities and annual income reserved and assigned to them, also counties, barony, marches, ducats, kingdoms and empires; Furthermore, all of these will be considered incapacitated and incapable (incompetent and incompetent) to these functions as relapsi and subversives in all respects (in everything and through everything), why, even if they first abjured such heresies in public judgment, can never and at no time be returned, put back, reinstated and rehabilitated in their primitive state in the cathedral churches, metropolitan, patriarchal and primatial or in the dignity of the Cardinalate or in any other greater or lesser dignity, (or whatever other greater or lesser dignity) in their active or passive voice, in their authority, in their monasteries and benefices or in their county, barony, marquisate, duchy, kingdom and empire; on the contrary, are abandoned to the discretion of secular power which claims the right to punish them, unless showing the signs of true repentance and the fruits of due penance, for the kindness and clemency of the See itself, are not relegated to some monastery or other place subject to rule to devote themselves to perpetual penance with the bread of pain and the water of affliction.

They will be considered as such (relapsi and subversive) from everyone, of any state, degree, condition and pre-eminence and of any dignity, including episcopal, archiepiscopal, patriarchal, primatial or other major ecclesiastical even cardinal, or that they are invested with any secular authority and excellence, like the comital, the baronial, the marquis, the ducal one, the royal and the imperial, and as such people should be avoided (avoid) and excluded from every human consolation.

 

4 – Extinction of the holiday

Those who claim to have a right of patronage (patronage right) and the appointment of suitable people to lead the cathedral churches, including subways, patriarchal, primatials or even monasteries and other ecclesiastical benefices made vacant as a result of such privations (by privation of such vacancies), so that they are not exposed to the inconveniences of a daily holiday (vacation), but after having rescued them from the servitude of the heretics, are entrusted to people capable of faithfully directing peoples in the path of justice, they will have to present to Us or to the then reigning Roman Pontiff, these people suited to the needs of these churches, monasteries and other benefits, within the time limits established by law or established by particular agreements with the Headquarters, otherwise, after the deadline as prescribed above, free disposal, of churches and monasteries, or even the aforementioned benefits, be devolved by full right to Us or to the aforementioned Roman Pontiff.

5-Penalties for the crime of aiding and abetting heresies

Furthermore, will incur the sentence of excommunication "ipso facto", all those who knowingly (knowingly) they will assume the responsibility of welcoming (receipt) and defend, or favor (favor them) those who, as already said, are caught in the act, either confess or be convicted in court, or give them credibility (believe) or teach their dogmas (to dogmatize their dogmas); and be held as infamous; nor are they allowed, nor can they be (nor can they be admitted) with you, both in person, either in writing or by delegate or attorney for public or private positions, advice, or synod or general or provincial council, nor conclave of cardinals, nor any congregation of believers or election of anyone, nor will they be able to testify; they will not be untestable, nor called to hereditary succession, and no one will be held accountable to them in any matter; whether they then have the function of judges, their sentences will have no value and no case will be brought to their hearings; if lawyers their patronage is totally refused; if I noticed, the deeds drawn up by them are without force or validity.

Beyond that, let them be the private clerics of each and every one of their churches, also cathedrals, metropolitan, patriarchal and primatial, of their dignities, monasteries, ecclesiastical benefits and positions (and ecclesiastical offices) in any way, as reported above, from qualifications obtained also regularly, from them as from the lay people, even if coated, as has been said, regularly of the aforementioned dignities, are private "ipso facto", even if in regular possession, of every kingdom, duchy, domain, fiefdom and every temporal good possessed; their kingdoms, ducats, domini, fiefdoms and other assets of this type, they will become by right, of public property or even property of those first occupants who are in sincerity of faith and in unity with the Holy Roman Church under our obedience or that of our successors, the canonically elected Roman Pontiffs.

 

6 – Nullity of ordinary jurisdiction

and pontifical in all heretics.

 

 

Let's add that, if it ever happens in some time that a bishop, although acts as an archbishop or patriarch or primate or a cardinal of the Roman Church, as said, or a legacy, or the Roman Pontiff himself, than before his promotion to cardinal or his elevation to Roman Pontiff, had deviated from the Catholic faith or had fallen into some heresy (or had incurred a schism or had caused one), be nothing, invalid and without any value (Nothing, void and empty exists), his promotion or elevation, even if it took place with the agreement and unanimous consent of all the cardinals; nor can it be said that it is validated with the receipt of the office, of the consecration or subsequent possession or quasi-possession of government and administration, or for enthronement or adoration (adoration) of the Roman Pontiff himself or for the obedience shown by all and for the lapse of any period of time in the said exercise of his office, nor could any part of it be considered legitimate, Well yes judge to have attributed or attributed a null faculty, to administer (no … possibility) to such persons promoted as bishops or archbishops or patriarchs or primates or assumed as cardinals or as Roman Pontiff, in spiritual or temporal things; but they lack any strength (they lack strength) each and every one (each and every one) of any of their words, action, administrative work or consequent thereto, cannot confer any firmness of law (absolutely no firmness or right), and the people themselves who had been thus promoted or elevated, are by the fact itself (by himself) and without the need for a further declaration (without any declaration to be made from above), private (you are private) of every dignity, place, honor, title, authority, charge and power (authority, office and power).

7 – The right of subordinates to withdraw

And to the greater confusion of those promoted and elevated in this way, where they intend to continue the administration, it is permissible to request the help of the secular arm, nor for this reason, those who withdraw from loyalty and obedience towards those who had been promoted and elevated in the way already mentioned, are subject to any of those censures and punishments imposed on those who would like to sever the tunic of the Lord.

8 – Permanence of previous documents and derogation of the contrary

They do not preclude the applicability of these provisions, the constitutions and apostolic ordinances, nor the privileges, the indults and the apostolic letters addressed to the bishops, archbishops, patriarchs, primates and cardinals, nor any other provision of any content or form and with any clause nor decrees even if issued "motu proprio" (even by his own motion) and with certain knowledge in the fullness of Apostolic power, or promulgated consistorially or in any other way and reiteratedly approved and renewed or inserted into the «corpus iuris», nor any conclave chapter, even if corroborated by oath or apostolic confirmation or strengthened in any other way, including the oath by the same.

Bearing in mind all the resolutions specified above, they must be considered as inserted, word for word, in those that must remain in force (at other times they will continue in their strength), while we hereby waive all other provisions contrary to them, only in a special and express way (while he is taxing specifically and express).

9-Solemn publication mandate

So that news of these letters reaches those who are interested in them, we want them, or a copy thereof (which must be authenticated by signature of a public notary and the affixing of the seal of a person invested with ecclesiastical dignity), are published and posted on the doors of the Basilica of the Prince of the Apostles in Rome and of the Apostolic Chancellery and placed at the corner of the Campo dei Fiori by one of our couriers; and that a copy of them be left posted in the same place, and that the order of publication, of posting and leaving copies posted is sufficient for the purpose and is therefore solemn and legitimate the publication, without having to request or wait for anything else.

10 – Illegality of contrary Acts and criminal and divine sanctions
