Così l'ex pm Nordio smonta le accuse a Salvini: "Un paradosso"

Magistrate Carlo Nordio on the investigation against Salvini: “The idea that the Prosecutor's Office can intervene in migratory choices is not only bizarre, but irrational and unmanageable”
Of Claudio Cartaldo
Carlo Nordio he is the magistrate who in the 1980s, just to mention one case, led the investigations into the Venetian Red Brigades and kidnappings.
He knows a lot about robes and politics, given that in the 1990s he also had to be interested in Tangentopoli. Bene. Today Nordio signs an editorial on Messenger which in some way "dismantles" the investigation opened by prosecutor Luigi Patronaggio against Matteo Salvini.
Let's go in order and, as much as possible, let's let the former magistrate himself speak. First of all, Nordio points out that the registration in the register of investigated of the Interior Minister would have arrived after the deposition of the Interior Ministry officials heard in Rome by the Agrigento prosecutor. “The first observation – writes the former magistrate on Messenger is that these minutes should be secret, how secret the entire investigation should be“. But let's move on. And let's get into the merits of the accusations made against Salvini, investigated for kidnapping, illegal arrest and abuse of office.
Second what has emerged in recent hours, it seems that the decision not to disembark the migrants came from Salvini via telephone. Therefore, a formal and written act would be missing. “In the absence of an official document – explains Nordio then – it is almost impossible to reconstruct the ministerial decision, its content and its training process. Then it is difficult to understand whether the port of Catania has been identified as a transit port only, or as a safe haven, or what else”.
On the alleged crimes, Nordio makes a point-by-point reasoning. “L’illegal arrest – he writes on Messenger presupposes, precisely, an arrest in the technical sense, and here it seems that no one was arrested”. So, the first hypothesis of crime was "dismantled".. On the kidnapping, Instead, the former magistrate says that “if Catania was just a transit port, obviously the problem does not arise. If instead it was the landing place, it is the discretion of the Minister to decide whether a landing is compatible with public order". This is why for Nordio challenging the head of the Interior Ministry for the kidnapping is “a paradox”.
Finally, there remainsabuse of office. Hypothesis of crime that Nordio defines “safety net for possible declassification of the previous hypotheses”. “Ma – explains the former magistrate – it is such a vague and vague crime that it is very difficult to prove its commission, especially in a highly discretionary activity”.
But it is not just a legal question. For Nordio, a "political aspect" must also be evaluated here. The former magistrate criticizes Salvini for the “picturesque terms” he uses, but the hypothesis that he has to resign to be registered in the register of suspects is "colossal stupidity". The reason? “Since in fact registration is automatic following a complaint that is not anonymous – explains Nordio – we would make the survival of a minister depend on it, and perhaps of a government and a legislature, not only from a possible improvident initiative of a hard-working magistrate, but even from that, interested, of a motivated citizen“.
Here's why “the idea that the Prosecutor's Office can intervene in migratory choices is not only that bizarre, but irrational and unmanageable“. The reason? A politician can be "sanctioned", if the choices made are wrong, from his electorate. Nobody, Instead, can intervene on prosecutors who “they do not suffer any sanctions for any wrong choices”.
In the end, in an article also published by Nordic are ImolaOggi, the former prosecutor addresses Patronaggio directly: “The initiative of the Public Prosecutor of Agrigento – writes – it is certainly commendable, however we allow ourselves to remind him, always by virtue of our seniority, that the boundaries between diligent diligence and imprudent exhibitionism are thin and uncertain“.
