While at an international level there is a call for a suspension of donation in cardio-circulatory arrest, as “cardiac death” can be reversible, in Italy where it is illegal (L.91/99) they are practicing it, "Quatti Quatti", in various hospitals. Tactics of fait accompli (not reported nor prosecuted thanks to hidden complicity) to then obtain the legalization without debate of a predatory "custom".. Many believe that the ethical problems related to donation after cardiac death (DCD, Donation Cardiocirculatory Death) they were “resolved” and that it is not clear why donation after cardiac death should be rejected. In this paper we will argue that non-beating heart donors may not yet be dead, and therefore that the donation of organs from people in cardiac arrest may contravene the rule of donation after death.
