M immo Lucano had many friends by his side, since he was hit by the investigation which led him first to house arrest and then to the ban from residing in Riace, in the Municipality which it has transformed into a global symbol of hospitality.

But one of these friends was better friends than others, providing him with valuable advice under the table on how to get out of trouble. They were very authoritative advice, because this friend is a magistrate serving at the Court of Appeal of Catanzaro, repeatedly intercepted by the Financial Police while talking to the former mayor or sending him messages and emails. The theme is always the same: the ongoing investigation by the Locri Prosecutor's Office, the one that ended last April 11th with the indictment of Lucano and twenty-six other people for criminal association, fraud, corruption and aiding illegal immigration. The judge gives his advice, insults Lucan's opponents, and above all it gives the friend a precious warning: «Don't talk on the phone». In practice, warns him that he can be intercepted.
The judge is called Emilio Sirianni, and he risked paying dearly for his help to Lucano. The Locri Prosecutor's Office, after coming across his wiretaps, decided to open an investigation. First an exploratory file, Then, faced with the mass of elements that emerged, registering Sirianni in the register of suspects for aiding and abetting. At the end of the preliminary investigations, the Prosecutor's Office asked to close the investigation. But in the same provision the investigators have harsh words for their colleague: «The attitude maintained – they write – it was unbecoming of a person belonging to the judicial system, who was also aware that she was speaking to a person under investigation"; and recall that «on several occasions Dr. Sirianni alerted Lucano to speak to him in person, avoiding telephone communications».

"Permanent advice": thus the prosecutor of the Republic of Locri, Luigi D'Alessio, Sirianni label in the final act of the investigation. «During the investigation – writes the prosecutor – constant relationships emerged between the main suspect, Lucano Domenico, and Sirianni Emilio, magistrate serving at the Court of Appeal of Catanzaro". After the first information from the GDF on the relationship between the two, investigations were delegated aimed at verifying whether in the seized material, in particular in the IT tools used at Lucano, there were further traces of the close relations with Sirianni". It was the same magistrate, on the other hand, to urge Lucano to delete the emails he exchanged with him.
It is Sirianni who indicates to Lucano how to respond to the Prefecture of Reggio, which raised a series of doubts about the management of reception projects. The mayor sends the papers he receives to the judge, he explains to him how to defend himself, prepare the answers for him to send to the Prefect, he even takes care of his press conferences «organizing in his favor a basis of popular consensus to support his action in the field of reception.
In the papers of the Locri Prosecutor's Office, Judge Sirianni appears as a figure halfway between an image consultant and a defense lawyer. The Prosecutor's Office itself appears very doubtful that these functions are compatible with that of a magistrate, but he does not believe he is facing a crime. «From the investigative documents it emerged that even in the cases in which Sirianni drew up counter-arguments or defense notes in favor of Lucano, he in no way indicated or suggested methods that could be considered extraneous to the defense version or capable of polluting the evidentiary scenario". As for the "certainly inappropriate" epithets addressed to public figures, like the Catanzaro prosecutor Nicola Gratteri or the former Interior Minister Marco Minniti, the judge addressed them privately: therefore there is no defamation. By Gratteri, in particular, Judge Sirianni and Lucano dealt with it in October last year, when the prosecutor of Catanzaro goes on television and dares to invite people to "read carefully" the papers accusing the former mayor: This is enough to set the two off. «Exemplary of the role of “to the council” assumed eql Sirianni the episode in which he suggests to Lucano the tenor of the statements to be made to the press on the occasion of the comment made by the chief prosecutor of Catanzaro regarding the Riace affair. Sirianni after suggesting the answers to be given to the press, advises Lucano not to let anyone read the contents of the email and to delete it".
The Troubles of Lucan, as is known, they are not finished: Another investigation for forgery and fraud was closed, others are underway. He will continue to have by his side, come "counselor", a judge? And the CSM has nothing to say about it?
