Athens, 27 I say - La European Court of Human Rights she managed to give birth to a messy sentence, to think well, that in fact paves the way for the application of sharia. The Court has in fact issued a definitive ruling in which it has condemned Greece for imposing the application of sharia in an inheritance dispute against the wishes of a deceased person who had drawn up a will according to the Greek Civil Code. The man had expressly demonstrated, Therefore, the desire not to defer to the provisions of Islamic law. The deceased, belonging to the Muslim community, he had designated his wife as sole heir in a will drawn up before a notary in accordance with Greek law. Paradoxically the Greek courts had established that, being the Islamic man, the will could not be valid and the matter had to be regulated by a mufti according to sharia.

I meno attenti, più o meno tutta la stampa europea tranne Le Figaro, hanno così sottolineato la condanna della Corte senza però notare un particolare affatto trascurabile, On the contrary. In practice la sentenza sostiene che, a patto che sia volontaria, la sharia in Europa è ammessa. Nella fattispecie contestata dalla Corte, l’uomo aveva espresso la volontà di non rimettersi ai dettami della legge islamica. Se avesse però dichiarato il contrario, sempre secondo la Corte, di fatto non ci sarebbe stato alcun problema ad applicarla.
Si tratta quindi di una sentenza grave e piuttosto preoccupante per le conseguenze che potrebbe scatenare. Why, in a nutshell, la Corte pone sullo stesso piano legge islamica e legge di uno stato sovrano membro dell’Unione Europea, declassando quest’ultima a una delle tante leggi possibili. Tutto dipende in pratica dalla volontà del singolo appartenente a una comunità religiosa. Ma a questo punto, si può facilmente desumere, appartenente a una qualsivoglia comunità.
