According to the former Foreign Minister of the Letta government, Emma Bonino, dal 2014 al 2016 the Renzi government would have committed itself on behalf of Italy, in agreement with other European governments, to welcome all migrants arriving in Europe. And so far nothing new, given that this is written in black and white on the agreements relating to the Triton operation. The problem arises if, come the former Defense Minister of the Letta government veiledly implied, Mario Mauro, this had happened in exchange for greater flexibility on the part of the EU on our public finances, circumstance evidently not written anywhere, but everything about a possible secret agreement between the Renzi government and the EU. In exchange for flexibility, which served him for political purposes, it is possible that Renzi betrayed the country, allowing migratory invasion, addressed solely to our territory? The statements of Bonino and Mauro, if read together, they would lead to that much. Many have talked about it, making even harsh criticisms, but no one made a decisive point: if there was an agreement of that type, come the secret exchange agreement between oil and migrants in Malta (of which above Libero news has already been given), this would even have criminal implications.
In fact, there would be criminal liability, as well as political, held by the former Prime Minister and any ministers competing with him. Art. 243 of the penal code states: «Whoever holds intelligence with the foreigner so that a foreign state wages war or carries out acts of hostility against the Italian state, or commits other acts aimed at the same purpose, is punished with imprisonment of not less than ten minutes. If war ensues or hostilities occur, life imprisonment applies".
The purpose of the conduct does not necessarily have to be war, but any act of hostility towards the State. E, apparently, these would be secret agreements, given that Renzi partially defends himself by declaring that the Triton agreements are written in black and white, leaving the other part of the problem unanswered, that of exchange with the flexibility of which no mention is made in these agreements.
The provision of the penal code punishes the conduct of anyone who enters into agreements with the foreigner, of any kind, in order to induce the foreign state (or more foreign states) to wage war or in any case to carry out acts of hostility towards the Italian State, which do not necessarily have to translate into acts of violence. So what are "hostile acts"?? The "cessions of sovereignty" fall within the category of hostile acts punished by the art. 243 of the penal code? We start from the assumption that the cited article punishes crimes against the personality of the State, therefore against its three constituent elements: people, territory and power of empire. Even just one of them would fail, the State would also disappear. Renzi, in exchange for flexibility on accounts, which in fact did not exist, it would have ceded a further part of our national sovereignty. And if someone gives up portions of national sovereignty in secret, without transparent agreements, certainly carries out a hostile act towards and to the detriment of the State. In whose name the Renzi government would have acted for that wicked agreement (secret) with the foreigner? Because he is a foreigner, let's be clear. In the name of who or what, and with whom, Renzi would have traded the migrant issue for greater flexibility on public finances? And for whose benefit?
In order to clarify things, we need it, in our opinion, two things 1) a public prosecutor who opens a case and investigates the matter; 2) a parliamentary commission of inquiry to shed light on this ugly story.
