Something's happening, something that perhaps not everyone knows, and they don't know it because those who should inform them are interested in keeping a low profile. Something about the internet and our freedoms. We are now accustomed to network attacks coming from our Parliament, the Italian Parliament, but this comes a long way, much higher. To be precise, by the European Parliament.
Yesterday the Legal Affairs Committee of the European Parliament, After 21 months of discussions on Copyright law, was called upon to decide: whether to accept the so-called Oettinger/Voss version of the plan, or that of taxation on links and preventive censorship, or the more reasonable, common sense version of German Green MEP Julia Reda. E, needless to say, voted for the Oettinger/Voss alternative, Oettinger was that, you will all remember it, who said that the markets would teach Italy how to vote.
What does it mean? It means that if the 4 in July the European Parliament met in plenary in Strasbourg, given yesterday's favorable opinion from the Commission, should vote to ratify this Copyright Act, beh! From that moment on, if you upload your own content to the web, you may encounter unpleasant messages such as: “You don't have a license for this region, for this content", or uploading was disabled because “the likelihood of copyright infringement is high”, or that “you need to wait while your vacation photos are uploaded, because they must first be compared with all the human knowledge of the shots taken by the rights holders". The debate on the Internet could boil down to this!
Let's take the article for example 11, which establishes the so-called “link tax”. We're not talking, to avoid misunderstandings about films or songs or entire books, but we are talking about the text that, quoted verbatim refers, “even to the smallest fragments of articles containing news”, that they “must have a license”. You know that little preview text that appears next to or below a link, in the absence of which no one in their right mind would dream of clicking? Ecco, that should also be properly licensed!
But listen to what the article says 13. “Online platforms are responsible for copyright violations of their users” and “must in any case implement preventive filters on uploads”. It means that the algorithms will reject a priori any content that "could" infringe copyright, before it even appears online. But algorithms are not immune to false positives and certainly cannot distinguish between eligible uses, like parodies, i meme, the right to criticize… There is no concession to the very concept of “Fair Use”. Ecco, for example, it will be impossible to publish a photo of anyone with a writing underneath, exactly memes, unless you took that photo yourself, and even then you will still be judged "guilty" unless you prove yourself "innocent" and wage long battles to get your content back online. This ControRassegna will also become impossible to achieve, unless you cut any image and turn it into a major television media. And who knows, if this law were to be retroactive, who knows how many channels, millions will be blacked out in the coming months. Furthermore, who will benefit from it? Not so much the publishers, as you might expect, because similar laws in Spain and Germany have already demonstrated that this policy leads, actually, to a decline in readings and articles. Instead, it will be good for those who have the means and technologies to implement these powerful algorithms, these filters. Clearly we are talking about Google and Facebook, while all other platforms will have to disable the possibility of uploading even simple links. So monopolists will become even more monopolists.
Tim Berners-Lee, the inventor of the World Wide Web, stated that this is “an unprecedented step towards automated surveillance and control”. And even the rapporteur at the United Nations who deals with freedom of opinion and expression, he said we are moving towards "preventive censorship" that will "restrict freedom of expression".

Some of the rules contained in the proposed directive approved yesterday by the Legal Affairs Committee of the European Parliament are poorly thought out and worse written, in a sloppy manner, approximate, difficult to apply. It's a classic rule against: it was written with Google and co. in mind. But it will necessarily have to be applied to everyone, even the smallest of start-ups. Google and its partners are given the task of deciding which contents can remain online and which, vice versa, can be removed. And that's exactly what will happen, because they will decide when to risk a lawsuit for copyright infringement and when not to risk it. They will risk it when the user has broad shoulders and they will not risk it when the user does not have broad shoulders. There will be less freedom of information for everyone. Greenpeace: hunting for plastic in the sea
