Blasphemy against Islam is a crime. This is what emerges from the ECHR ruling linked to the Sabaditsch-Wolff case.
I am 47 the European countries over which the European Court of Human Rights (ECHR). Ora, all member countries will be forced to accept the "rules" regarding what determines the crime of blasphemy for the Muslim religion.
In a nutshell, we could all be accused of having offended Islam with our statements and this in the name of "religious peace". Still mindful, or perhaps better to say scared, from the memory of the tragic events linked to the Charlie Hebdo affair.
Once again, therefore, we lower our heads to calm the offensive, although this method seems not to have never worked throughout history.

Offending Jesus and Mary is not a crime

There is a precedent on the subject of blasphemy and offense against religious symbols which leaves us very dumbfounded and we want to start precisely from this.
The Strasbourg court less than 12 months ago he had issued a completely opposite ruling regarding the Catholic religion. The reason for the dispute at the time was an advertising campaign in which Jesus and Mary were used to promote a clothing brand. The company was sanctioned by Lithuania with a heavy fine for having offended public morals.
But the, ECHR overturned that sanction by ruling, than to be sanctioned, it had to be Lithuania for violating freedom of expression that, citing the ruling, “constitutes one of the essential foundations of a democratic society”. That, again according to that ruling “it extends to ideas that shock, offend or disturb". At this point we have to ask ourselves: “Because we Catholics have no right to feel offended?”
The facts are inspired by what sparked the case of Elisabeth Sabaditsch-Wolff, found guilty, In the 2011, of having “denigrated religious teachings”.
In the 2009, he had held a conference on Islam, in Austria, considered, by public opinion and the courts, as incitement to hatred against Islam, pursuant to art. 283 of the Austrian Criminal Code.
He had said, in particular, that Muhammad was a pedophile, as his wife Aisha had only 6 years: “A 56 year old and a little girl 6 years? What to call it, if not a case of pedophilia?”.

The European Court's condemnation of blasphemy against Islam

Elisabeth Sabaditsch-Wolff paid 480 euros to avoid going to prison and he never obtained understanding for his statements.
Here's what the court said: “The Court noted that domestic courts have amply explained why the actress's comments managed to arouse justified indignation; in particular, they had not been expressed objectively, that contributed to promoting a debate of public interest (for example on early marriages), but they could only be understood as intended to demonstrate that Muhammad was not worthy of devotion.".
“Finally, the Court found that in the present case the national courts had struck a careful balance the actress's right to freedom of expression with the right of others to protect religious feelings and maintain religious peace in Austrian society.
The Organization of Islamic Cooperation (Oci), of which they are well part 57 Muslim countries, welcomed the sentence, which sets a very dangerous precedent and achieves a small victory over the European Union, to whom Muslims have long been asking for "limits to freedom of expression when criticizing Islam".
