The Supreme Court clarifies a law that has never been obscure: the 242/2016 regulates the cultivation of hemp, the transfer remains prohibited.
We publish the comment of Livatino Study Center at the news of the sentence with which the Court of Cassation decreed that the law does not allow the sale or transfer in any capacity of products derived from the cultivation of cannabis such as oil, the leaves, the inflorescences and the resin.
The Supreme Court ruling has the merit of shedding clarity on an issue that in reality was not obscure: law no. 242/2016 regulates the cultivation of hemp, but the transfer remains prohibited.
Beyond your letter, that law had been improperly understood as a green light for the retail sale of marijuana, albeit within the limits of 0.6, however suitable to cause the doping effect. Now there are no more alibis: cannabis shops are not the tool to achieve de facto legalization.
It will be necessary to work on the level of prevention to overcome the perception of legal cannabis that has spread especially among adolescents, and to make the ban something concrete.
